These Terms & Conditions govern the use of the Iconic MetalGear website and the purchase of products from Iconic Elements Inc. (doing business as Iconic MetalGear). By accessing our website or purchasing our products, you agree to these terms.

1. Who We Serve

  • We sell to both consumers and businesses.
  • All orders are subject to these Terms & Conditions and any additional terms referenced at the point of sale.

2. Product Installation

Iconic MetalGear does not perform installations. Customers and/or installers are responsible for proper installation.

Installation instructions are included with most products and can be requested from our sales team.

Load Ratings

Customers are encouraged to contact us regarding specific load ratings on our products.

Headache Rack Disclaimer

As stated in the NSC Standard 10: Cargo Securement, Divsion 5 – Front End Structures – Application 23(3) A cab shield (Headache rack) is not a front end structure or part of a cargo securement system. Therefore NO D.O.T. requirements/approvals are applicable.

  • Headache racks cannot meet the requirements of CFR 393.114.a. Cargo must be in contact with the front end structure for the CFR 393.114.a to apply.

Iconic MetalGear promotes that all operators be in compliance with all other load securement requirements as stated in 393.100 to 393.142.

“As per the Ministry of Transportations “Commercial Motor Vehicle Operator’s Safety Manual” the following applies:

Within Module 14 – Cargo Securement, it refers to requirements that are adopted from the National Safety Code (NSC) Standard 10, Cargo Securement, as the standard for securing loads in Ontario. Referenced in the subsection “Requirements for Securement Devices” it talks to Front End structures and that the rules concerning this topic are included in NSC Standard 10.

3. Intellectual Property

  • All designs, images, text, videos, and other creative material are the intellectual property of Iconic Elements Inc.
  • Content is protected by copyright and applicable patent law. Unauthorized use is prohibited.

4. Changes to Products, Pricing, and Orders

  • Iconic reserves the right to change pricing, cancel orders, or modify product designs at any time.
  • Product representations on the website are provided in good faith, but products are not guaranteed to match images exactly.

5. Jurisdiction & Governing Law

This agreement is governed by the laws of Ontario, Canada.

6. Use of the Website

By using this website, you agree that:

  • You will comply with all applicable laws
  • You will not misuse the site or attempt unauthorized access
  • You accept responsibility for any content you submit through forms or communications
  • You have read, understand, and agree to all terms, conditions, policies, and disclaimers as provided on this website.

  • Why not?
    • In Canada, under PIPEDA, implied consent for non-sensitive cookies (like analytics and functional cookies) is deemed as sufficient. Explicit consent is recommended if cookies track personal data or behavioral advertising.
    • U.S. (CCPA/CPRA in California) Requires that users can opt out of “sale/sharing” of personal information. A cookie banner or “Do Not Sell/Share My Data” link is common, but not required. We do not sell personal data. We only share data with trusted third parties as required to complete your order or provide services.
    • In the EU or UK, GDPR and ePrivacy regulations require explicit consent for most non-essential cookies, including analytics and marketing pixels. However, we do not actively market our products in the EU or UK where these regulations exist.
  • Iconic Elements Inc. will implement an opt-out or consent banner if required by law for a given jurisdiction or audience.
